Abstract

We are witnessing the birth of a global international law, the outcome of the constitutionalisation of the international legal system, which in turn is the result of the development and strengthening of ius cogens norms in issues related to the international protection of human beings. In this framework the constitutional principles designed to protect people are acquiring a fundamental importance and they should serve to inspire the interpretation and transformation of the international legal order. The result to date is an increasingly human-oriented international law, a law that is more inclusive and ultimately with even democratic connotations. What has yet to be achieved, however, is the development of the social face of international law and the full consolidation of the constitutional approach to the international legal order.
