The protection of cultural property in the European Union has been a constant concern since the beginning. However, the establishment of the single market prompted a specific regulation for its export as well as the setting of rules aimed at the restitution of cultural objects that had left illegally from one Member State and were located in another Member State. Those first standards had to be modified because they showed little practical application and, as result of that process, a new Directive was adopted in 2014. This norm has recently been incorporated into Spanish Law through the 1/2017 Act. With this new norm some deficiencies that the 36/1994 Act showed were fixed but it shows, in turn, some gaps for its application.
