Guidelines and Rules on the Conduct of Elections to the Governing Organs of the REDI, the REEI and the SYbIL*

I. GENERAL GUIDELINES AND RULES

1. Legal basis and purpose

The purpose of these guidelines and rules is to establish rules for the election of the members of the Governing Organs of the REDI, the REEI and the SYbIL (hereinafter referred to as the Journals), in accordance with the General Guidelines and rules on the composition and functions of their Governing Organs.

2. General rules

2.1. Application of the rules laid down in the Regulations on the Conduct of Elections to the Bodies of AEPDIRI.

The general rules of the Electoral Regulations relating to the AEPDIRI Organs** shall also apply to the holding of elections to the Governing Organs of the Journals. Consequently, the rules laid down therein on the eligibility requirements and incompatibilities of candidates, valid forms of communication and calculation of deadlines, publication of vacancies, types of candidatures, concurrence of nominated candidates, capacity to make nominations, content of nominations, publication of the lists of nominated candidates, as well as all relevant deadlines in this respect, shall be applicable to these (arts. 2-4 and 6-10). The rules on the organisation and procedure of elections shall also apply (art. 11 of the Electoral Regulations).

2.2. Incompatibilities for members of Journal Boards and candidates.

In addition to the incompatibilities stipulated in article 2.2 of the Regulations in question, candidates for membership of the Editorial Boards of AEPDIRI Journals may not stand for election if they are members of the Governing Board or Secretary of the Association, unless the functions in both organs were to be carried out by the member of the Association in question during fully successive terms of office. In turn, members of the Association may not simultaneously stand as candidates for membership of the Editorial Boards of more than two AEPDIRI Journals. In any case, if a member is elected to hold two posts, he/she may hold only one, proceeding in accordance with the provisions of section 6.

3. Capacity to make nominations for members of the Editorial and Advisory Boards of the Journals

3.1. The capacity of the Governing Board under the Guidelines and Rules of the Journals to make nominations to the General Assembly and to transmit to the General Assembly nominations received by the Members of the Association in relation to the Journal Boards shall be in accordance with the terms provided for in these Guidelines and Rules. Their own nominations shall be made by the Governing Board as such, in writing, through a letter addressed to the Secretary of the Association.

3.2. Nominations of candidates by other members shall also be governed by the rules of the Electoral Regulations relating to the AEPDIRI Organs.

4. Content of the nominations and setting of the required criteria for vacant positions on the Boards of the Journals and the electoral organisation for their filling. Early termination and vacancies

4.1. Nominations for members of the Boards of the Journals shall contain all the information detailed in the electoral regulations for the AEPDIRI organs. In addition, candidates may, if they deem it appropriate, add a further statement of their reasons for accepting their nomination, which shall not exceed one hundred and fifty words.

4.2. The configuration of the particular criteria required for the specific vacant positions on the different Journal Boards, as well as the electoral organisation for their filling, shall be carried out in application of the General Guidelines and Rules on the composition and functions of the Governing Organs of the Journals, ensuring, among other aspects, that the three disciplines (Public International Law, Private International Law and International Relations) are always adequately represented, as detailed in the following sections.

4.3. When, for any reason, a member of the Editorial Board of a Journal or its Secretary is removed from office, the Board may, if it deems it appropriate, appoint another person in his/her place, only for the total time remaining, although this shall not prevent the same person from standing as a candidate in the elections following the end of the full term of office initially foreseen.

II. SPECIFIC RULES FOR EDITORIAL BOARDS OF THE JOURNALS

5. Order for renewal in successive elections

5.1. REDI

Given that, according to its General Guidelines, the number of members of its Editorial Board is 9, is renewable in halves and must be composed of 4 members from Public International Law, 3 from Private International Law and 2 from IR, in each of the by-elections three lists of nominated candidates will be drawn up, distributed around the three disciplines that make up the Association, in such a way that voters can elect, in the renewal of half A), 2 candidates from Public International Law, 2 from Private International Law and 1 from International Relations, and in the renewal of half B), 2 from Public International Law, 1 from Private International Law and 1 from International Relations, as shown in graphs 1 and 2 of the Annex.

5.2. REEI

Given that, according to its Guidelines, the number of members of its Editorial Board is 8, it will be renewable in halves and an adequate representation of the disciplines that make up the Association is maintained with the proportion 3 (Public International Law), 3 (Private International Law) and 2 (International Relations), the three lists of nominated candidates shall be drawn up in such a way that the electors may elect, in the renewal of half A), 2 candidates from Public International Law, 1 from Private International Law and 1 from International Relations, and in the renewal of half B), 1 from Public International Law, 2 from Private International Law and 1 from International Relations, as shown in graphs 3 and 4 of the Annex.

5.3. SYbIL

Given that, according to its Guidelines, the number of members of the Editorial Board is 7, is renewable in halves and must be composed of 3 members from Public International Law, 3 from Private International Law and 1 from International Relations, the three lists of nominated candidates will be drawn up, in such a way that the electors can choose, in the renewal of half A), 1 Public International Law, 2 Private International Law and 1 International Relations candidate, and in the renewal of half B), only 2 Public International Law and 1 International Relations candidate, as shown in graphs 5 and 6 of the Annex.

6. Acceptance and withdrawal

6.1. Once the voting has been completed and the votes cast have been counted, the number of votes obtained by each candidate for each seat shall be announced. Each elected candidate shall then declare his or her acceptance or, on the contrary, his or her inability to perform the duties for which he or she has been elected. A candidate who has stood for membership of two different Editorial Boards must then opt for one of the two.

6.2. If a declaration of acceptance of a post is not made or transmitted after the results have been announced, but before the end of the session, the candidate shall be deemed to have withdrawn from the post. This rule shall also apply accordingly in the case of a person who has been elected as a member of two different Editorial Boards and has not declared his/her acceptance of one, in that he/she shall be presumed to have resigned from both.

Transitional provisions

The renewal by halves cannot take place completely until the elections to be held in 2019, since, although the 2017 elections will begin to apply the rules set out here, the members elected at that time will form the composition of the Councils together with those elected in 2015 in a different order to that set out here. Consequently, in order to ensure that, as of the 2019 elections, renewal can take place in strict compliance with the provisions of the General Guidelines and Rules on the Composition and Functions of the Journals' Governing Bodies and these Guidelines and Rules, the following procedure shall apply:

  1. In the 2017 elections, when the first partial renewal of the Editorial Boards takes place in accordance with the provisions of Rule No. 5 (1), (2) and (3) of these Guidelines and Rules, it shall begin with half B) of each Board.
  2. The Councils may take the necessary measures to ensure that all disciplines are sufficiently represented or to make up for a possible shortfall in the number of members of the Editorial Boards during the 2017-19 biennium.
